Careful reflection on this teaching of the Magisterium and on the evidence of reason, as mentioned above, enables us to respond to the numerous moral problems posed by technical interventions upon the human being in the first phases of his life and upon the processes of his conception.

 

 

1. What Respect Is Due to the Human Embryo, Taking into Account His Nature and Identity?

The human being must be respected as a person -- from the very first instant of his existence.

The implementation of procedures of artificial fertilization has made possible various interventions upon embryos and human fetuses. The aims pursued are of various kinds: diagnostic and therapeutic, scientific and commercial. From all of this serious problems arise. Can one speak of a right to experimentation upon human embryos for the purpose of scientific research? What norms or laws should be worked out with regard to this matter? The response to these problems presupposes a detailed reflection on the nature and specific identity -- the word "status" is used -- of the human embryo itself.

At the Second Vatican Council, the Church for her part presented once again to modern man her constant and certain doctrine according to which: "Life, once conceived, must be protected with the utmost care; abortion and infanticide are abominable crimes." (23) More recently, the Charter of the Rights of the Family, published by the Holy See, confirmed that "Human life must be absolutely respected and protected from the moment of conception." (24)

This Congregation is aware of the current debates concerning the beginning of human life, concerning the individuality of the human being and concerning the identity of the human person. The Congregation recalls the teachings found in the Declaration on Procured Abortion: "From the time that the ovum is fertilized, a new life is begun which is neither that of the father nor of the mother; it is rather the life of a new human being with his own growth. It would never be made human if it were not human already. To this perpetual evidence...modern genetic science brings valuable confirmation. It has demonstrated that, from the first instant, the program is fixed as to what this living being will be: a man, this individual-man with his characteristic aspects already well determined. Right from fertilization is begun the adventure of a human life, and each of its great capacities requires time...to find its place and to be in a position to act." (25) This teaching remains valid and is further confirmed, if confirmation were needed, by recent findings of human biological science which recognize that in the zygote resulting from fertilization the biological identity of a new human individual is already constituted.

Certainly no experimental datum can be in itself sufficient to bring us to the recognition of a spiritual soul; nevertheless, the conclusions of science regarding the human embryo provide a valuable indication for discerning by the use of reason a personal presence at the moment of this first appearance of a human life: how could a human individual not be a human person? The Magisterium has not expressly committed itself to an affirmation of a philosophical nature, but it constantly reaffirms the moral condemnation of any kind of procured abortion. This teaching has not been changed and is unchangeable. (26)

Thus the fruit of human generation, from the first moment of its existence, that is to say from the moment the zygote has formed, demands the unconditional respect that is morally due to the human being in his bodily and spiritual totality. The human being is to be respected and treated as a person from the moment of conception; and therefore from that same moment his rights as a person must be recognized, among which in the first place is the inviolable right of every innocent human being to life.

This doctrinal reminder provides the fundamental criterion for the solution of the various problems posed by the development of the biomedical sciences in this field: since the embryo must be treated as a person, it must also be defended in its integrity, tended and cared for, to the extent possible, in the same way as any other human being as far as medical assistance is concerned.

 

2. Is Prenatal Diagnosis Morally Licit?

If prenatal diagnosis respects the life and integrity of the embryo and the human fetus and is directed towards its safeguarding or healing as an individual, then the answer is affirmative.

For prenatal diagnosis makes it possible to know the condition of the embryo and of the fetus when still in the mother's womb. It permits, or makes it possible to anticipate earlier and more effectively, certain therapeutic, medical or surgical procedures.

Such diagnosis is permissible, with the consent of the parents after they have been adequately informed, if the methods employed safeguard the life and integrity of the embryo and the mother, without subjecting them to disproportionate risks. (27) But this diagnosis is gravely opposed to the moral law when it is done with the thought of possibly inducing an abortion, depending upon the results: a diagnosis which shows the existence of a malformation or a hereditary illness must not be the equivalent of a death-sentence. Thus a woman would be committing a gravely illicit act if she were to request such a diagnosis with the deliberate intention of having an abortion should the results confirm the existence of a malformation or abnormality. The spouse or relatives or anyone else would similarly be acting in a manner contrary to the moral law if they were to counsel or impose such a diagnostic procedure on the expectant mother with the same intention of possibly proceeding to an abortion. So too the specialist would be guilty of illicit collaboration if, in conducting the diagnosis and in communicating its results, he were deliberately to contribute to establishing or favoring a link between prenatal diagnosis and abortion.

In conclusion, any directive or program of the civil and health authorities or of scientific organizations which in any way were to favor a link between prenatal diagnosis and abortion, or which were to go as far as directly to induce expectant mothers to submit to prenatal diagnosis planned for the purpose of eliminating fetuses which are affected by malformations or which are carriers of hereditary illness, is to be condemned as a violation of the unborn child's right to life and as an abuse of the prior rights and duties of the spouses.

 

3. Are Therapeutic Procedures Carried Out on the Human Embryo Licit?

As with all medical interventions on patients, one must uphold as licit procedures carried out on the human embryo which respect the life and integrity of the embryo and do not involve disproportionate risks for it but are directed towards its healing, the improvement of its condition of health, or its individual survival.

Whatever the type of medical, surgical or other therapy, the free and informed consent of the parents is required, according to the deontological rules followed in the case of children. The application of this moral principle may call for delicate and particular precautions in the case of embryonic or fetal life.

The legitimacy and criteria of such procedures have been clearly stated by Pope John Paul II: "A strictly therapeutic intervention whose explicit objective is the healing of various maladies such as those stemming from chromosomal defects will, in principle, be considered desirable, provided it is directed to the true promotion of the personal well-being of the individual without doing harm to his integrity or worsening his conditions of life. Such an intervention would indeed fall within the logic of the Christian moral tradition." (28)

 

4. How Is One Morally To Evaluate Research and Experimentation on Human Embryos and Fetuses?

Medical research must refrain from operations on live embryos, unless there is a moral certainty of not causing harm to the life or integrity of the unborn child and the mother, and on condition that the parents have given their free and informed consent to the procedure. It follows that all research, even when limited to the simple observation of the embryo, would become illicit were it to involve risk to the embryo's physical integrity or life by reason of the methods used or the effects induced.

As regards experimentation, and presupposing the general distinction between experimentation for purposes which are not directly therapeutic and experimentation which is clearly therapeutic for the subject himself, in the case in point one must also distinguish between experimentation carried out on embryos which are still alive and experimentation carried out on embryos which are dead. If the embryos are living, whether viable or not, they must be respected just like any other human person; experimentation on embryos which is not directly therapeutic is illicit. (29)

No objective, even though noble in itself, such as a foreseeable advantage to science, to other human beings or to society, can in any way justify experimentation on living human embryos or fetuses, whether viable or not, either inside or outside the mother's womb. The informed consent ordinarily required for clinical experimentation on adults cannot be granted by the parents, who may not freely dispose of the physical integrity or life of the unborn child. Moreover, experimentation on embryos and fetuses always involves risk, and indeed in most cases it involves the certain expectation of harm to their physical integrity or even their death.

To use human embryos or fetuses as the object or instrument of experimentation constitutes a crime against their dignity as human beings having a right to the same respect that is due to the child already born and to every human person.

The Charter of the Rights of the Family published by the Holy See affirms: "Respect for the dignity of the human being excludes all experimental manipulation or exploitation of the human embryo." (30) The practice of keeping human embryos alive in vivo or in vitro for experimental or commercial purposes is totally opposed to human dignity.

In the case of experimentation that is clearly therapeutic, namely, when it is a matter of experimental forms of therapy used for the benefit of the embryo itself in a final attempt to save its life, and in the absence of other reliable forms of therapy, recourse to drugs or procedures not yet fully tested can be licit. (31)

The corpses of human embryos and fetuses, whether they have been deliberately aborted or not, must be respected just as the remains of other human beings. In particular, they cannot be subjected to mutilation or to autopsies if their death has not yet been verified and without the consent of the parents or of the mother. Furthermore, the moral requirements must be safeguarded, that there be no complicity in deliberate abortion and that the risk of scandal be avoided. Also, in the case of dead fetuses, as for the corpses of adult persons, all commercial trafficking must be considered illicit and should be prohibited.

 

5. How Is One Morally To Evaluate the Use for Research Purposes of Embryos Obtained by Fertilization in Vitro?

Human embryos obtained in vitro are human beings and subjects with rights: their dignity and right to life must be respected from the first moment of their existence. It is immoral to produce human embryos destined to be exploited as disposable "biological material."

In the usual practice of in vitro fertilization, not all of the embryos are transferred to the woman's body; some are destroyed. Just as the Church condemns induced abortion, so she also forbids acts against the life of these human beings. It is a duty to condemn the particular gravity of the voluntary destruction of human embryos obtained in vitro for the sole purpose of research, either by means of artificial insemination or by means of "twin fission." By acting in this way the researcher usurps the place of God; and, even though he may be unaware of this, he sets himself up as the master of the destiny of others inasmuch as he arbitrarily chooses whom he will allow to live and whom he will send to death, and kills defenseless human beings.

Methods of observation or experimentation which damage or impose grave and disproportionate risks upon embryos obtained in vitro are morally illicit for the same reasons. Every human being is to be respected for himself, and cannot be reduced in worth to a pure and simple instrument for the advantage of others. It is therefore not in conformity with the moral law deliberately to expose to death human embryos obtained in vitro. In consequence of the fact that they have been produced in vitro, those embryos which are not transferred into the body of the mother and are called "spare" are exposed to an absurd fate, with no possibility of their being offered safe means of survival which can be licitly pursued.

 

6. What Judgment Should Be Made on Other Procedures of Manipulating Embryos Connected with the "Techniques of Human Reproduction"?

Techniques of fertilization in vitro can open the way to other forms of biological and genetic manipulation of human embryos, such as attempts or plans for fertilization between human and animal gametes and the gestation of human embryos in the uterus of animals, or the hypothesis or project of constructing artificial uteruses for the human embryo. These procedures are contrary to the human dignity proper to the embryo, and at the same time they are contrary to the right of every person to be conceived and to be born within marriage and from marriage. (32) Also, attempts or hypotheses for obtaining a human being without any connection with sexuality through "twin fission," cloning or parthenogenesis are to be considered contrary to the moral law, since they are in opposition to the dignity both of human procreation and of the conjugal union.

The freezing of embryos, even when carried out in order to preserve the life of an embryo -- cryopreservation -- constitutes an offense against the respect due to human beings by exposing them to grave risks of death or harm to their physical integrity, and depriving them, at least temporarily, of maternal shelter and gestation, thus placing them in a situation in which further offenses and manipulation are possible.

Certain attempts to influence chromosomic or genetic inheritance are not therapeutic but are aimed at producing human beings selected according to sex or other predetermined qualities. These manipulations are contrary to the personal dignity of the human being and his or her integrity and identity. Therefore, in no way can they be justified on the grounds of possible beneficial consequences for future humanity. (33) Every person must be respected for himself: in this consists the dignity and right of every human being from his or her beginning.

Occasionally I read something by one of my fellow pro-lifers that is so clever, insightful and wise that I feel compelled to share it with those who have become accustomed to daily commentary from the Catholic pro-life perspective. And when the one writing the commentary is constitutional attorney Matt Bowman, who I remember fondly from his days as a college student, I am inspired to spread his words far and wide.

Before I do so, I will recommend Matt's latest web effort, which is a site devoted to exposing the aborto-holic nature of President Barack Obama's activity, be they appointments, executive orders or otherwise. You will see it for yourself at http://abortobama.com.

As I continue to bask in the reality that I just turned 65 years old, I hope that you will bask in the words of this young, talented and dedicated attorney. God is good! 

Sebelius and Kmiec Catholicism By Matt Bowman

After focusing on the economy as long as he could, Obama necessarily had to face abortion again. He filled many lower appointments directly from groups like NARAL, but on Saturday he announced the queen of all pro-abortion nominees, Kansas Gov. Kathleen Sebelius.

Pro-life advocates are forming ranks against Sebelius as Obama's choice to head the Department of Health and Human Services. Sebelius is a long-time opponent of even moderate abortion regulations, and is the patron of notorious late-term abortionist George Tiller of Wichita. Her nomination came a day after Obama announced his plan to refuse to enforce decades-old laws that protect doctors from being forced to kill unborn children.

But the most intriguing component of Sebelius's nomination is her Catholicism. Not that Catholic abortion supporters are rare – see Obama's failed nominee to HHS, Tom Daschle. But Sebelius is significant as an attempt by Obama to foment a civil war within Catholicism to neutralize its pro-life efforts.

Like a shrewd general, Obama is using Catholics themselves as his ground troops. Two dozen prominent Obama supporters quickly launched a letter supporting Sebelius, and claiming that they are Catholic and pro-life. The letter's signers are the same liberal Obama Pro-Lifers from his presidential campaign, led by Professor Doug Kmiec and the Soros-funded group "Catholics United."

What is different about this new strain of cafeteria Catholics is not their support for abortion politicians, but their claim that they are the true abortion opponents within Catholicism. They reveled in Obama's season of audacity, and simply claimed that the most extreme pro-abortion candidate in history was really a pro-lifer. It worked. In an election about economics, they gave Catholics the rationalization they needed to vote for political celebrity but against the unborn.

Yet pro-lifers hoped that the Obama Pro-Lifers might really oppose Obama's pro-abortion policies. They dreamed that Doug Kmiec might actually do some good, by using Obama's listening ear by convincing him to moderate his extremist abortion agenda.

Till now, it was unclear which path the new Catholic left would take. They were silent when Obama awarded international funding to abortion organizations. But doubts were raised when several of them actually attacked the pro-life campaign against Obama's Freedom of Choice Act, even though that campaign is the only thing keeping FOCA from becoming reality.

The Obama Pro-Lifers' letter has smashed any such hopes. They have declared full-scale war against Catholic and evangelical pro-life political activity. In its place, they seek to elevate themselves as the arbiters of their own Vichy Catholicism and liberal Christianity, which actually supports the specific goals of an abortion-loving government regime.

It is a bold move. Their letter plants the flag of Catholicism in the heart of late-term abortion advocacy, declaring that Sebelius "has made clear that she agrees with church teaching that abortion is wrong and has lived and acted according to that belief."

Ironically, pro-lifers in the past, by fighting Democratic administrations, actually made it theoretically possible for liberals to vote pro-abortion, because the pro-lifers negated the damage. But this new brand of self-styled Catholicism has chosen to engage in media campaigns precisely for the purpose of blunting pro-life efforts, so that the specific pro-abortion agenda item will succeed. They hope that "Catholics" like
Sebelius will define a new generation of Christian abortion advocacy.

Yet the Obama Pro-Lifers are taking a risk. By claiming that Sebelius "lives and acts" not just any high-minded ideals, but specifically pro-life Catholic teaching, the letter's signers are donning their own mitres and claiming to teach Catholics what the faith is. That is a role only a bishop can fill, and if Catholic bishops recognize the attempt to usurp their own authority, they just might respond.

As George Weigel notes, the bishops can largely neutralize the Obama Pro-Lifers. They relegated the last attempt at a Trojan-horse group, "Catholics for a Free Choice," to fringe status by repeated condemnations. Likewise, an unprecedented number of bishops embarrassed Nancy Pelosi and Joe Biden when they played theologian on abortion last fall and simultaneously made abortion a possible winning issue before the economy collapsed.

The bishops' pro-life director Cardinal Rigali declared in September that it is spurious to speak of "abortion reduction" or pro-life intent while wedding oneself to the a pro-abortion regime and opposing even modest restrictions on abortion. Yet Sebelius and the Obama Pro-Lifers now define such abortion stumping as "living and active" pro-life Catholicism.

Finally, Sibelius's own bishop in Kansas City met with her and afterwards declared that she is assuredly not "living and acting" her pro-life Catholic faith – he even told her not to come to Communion. When Doug Kmiec writes a letter claiming the opposite, he is trumping the authority of a local ordinary. Even the gentlest Catholic bishop might not give up his seat so easily. And Kmiec is not likely to be satisfied merely with the See of Kansas City.

Why, just weeks into a 209-week term, assess a new American president's record on so esoteric a subject as the Middle East and Islam? In Barack Obama's case, because of:

(1) A contradictory record: His background brims over with wild-eyed anti-Zionist radicals such as Ali Abunimah, Rashid Khalidi, and Edward Said, with Islamists, the Nation of Islam, and the Saddam Hussein regime; but since being elected he has made predominantly center-left appointments and his statements resemble those of his Oval Office predecessors.

(2) The outsized role of the Middle East and Islam: His first fortnight in office witnessed an inaugural address that mentioned them prominently, a first diplomatic telephone call to Mahmoud Abbas of the Palestinian Authority, the appointment of two high-profile envoys, and the first interview granted to Al-Arabiya television channel.

What to make of this whirlwind?

Afghanistan and Iraq : No surprises – more emphasis on the former and less on the latter ("you're going to see me following through with dealing with a drawdown of troops in Iraq").

Iran : A willingness to talk to the Iranian regime mixed with a flabby reassertion of the unacceptability of Tehran's actions ("Iran has acted in ways … not conducive to peace and prosperity").

Arab-Israeli conflict : A strange mix: Yes, statements about Israel's security imperatives and no condemnation of its war against Hamas. But also effusive praise for the "Abdullah Plan," a 2002 initiative that has Arabs accept Israel's existence in return for Israel return to the June 1967 borders, a plan distinct from other diplomatic initiatives for its many loose ends and its total reliance on Arab good faith. Israeli elections on Feb. 10 are likely to bring a government to power not favorably inclined to this plan, spelling rocky U.S.-Israeli relations ahead.

War on terror : One analyst announced that Obama is "ending the war on terror," but this is speculation. Yes, early on Jan. 22, Obama referred to "the ongoing struggle against violence and terrorism," which avoided saying "war on terror," but later that same day he did precisely refer to the "war on terror." Given the many clumsy ways George W. Bush referred to this war, including "the great struggle against extremism that is now playing out across the broader Middle East," Obama's inconsistency so far suggests continuity with Bush more than change.

Reaching out to the Muslim world : Obama's reference to wanting to return to "the same respect and partnership that America had with the Muslim world as recently as 20 or 30 years ago" revises history, ignoring that 1989 was a bad year and 1979 the worst ever for U.S.-Muslim relations. (In November 1979 alone, Khomeini overthrew the shah of Iran and then seized the American embassy in Tehran, while an Islamist insurgency in Mecca inspired a wave of attacks against U.S. missions in eight majority-Muslim countries.)

Democracy : Harkening back to the good old days of "20 or 30 years ago" does contain a real message, however, as Fouad Ajami points out. This phrasing signals "a return to Realpolitik and business-as-usual" in relations with the Muslim world. Bush's "freedom agenda" has been in retreat for over for three years; now, with Obama, tyrants can breathe yet more easily.

Finally, there is the issue of Obama's personal connection to Islam. During the campaign, he denounced discussion of his connections to Islam as " fear-mongering," and those exploring this subject found themselves vilified. He so severely discouraged use of his middle name, Hussein, that John McCain apologized when a warm-up speaker at a campaign event dared mention "Barack Hussein Obama." After the election, the rules changed dramatically, with the oath of office administered to "Barack Hussein Obama" and the new president volunteering, "I have Muslim members of my family, I have lived in Muslim countries."

It's bad enough that family connections to Islam perceived as a liability when campaigning are suddently exploited once in office to win Muslim goodwill. Worse, as Diana West observes: "not since Napoleon has a leader of a Western superpower made so unabashed a political pitch to the people of the Muslim world."

To sum up, while Obama's retreat from democratization marks an unfortunate and major change in policy, his apologetic tone and apparent change in constituency present a yet more fundamental and worrisome direction.

Famed 82nd Airborne Heading to Afghanistan

The famed 82nd “All American” Airborne Division Headquarters is deploying to Afghanistan as part of President Barack Obama’s effort to bolster U.S. presence there, the Department of Defense announced Monday.

 

The 82nd will take over the role of the 101st Airborne Division directing the operations of all American combat troops in Afghanistan. The new commanded will be designated the Combined Joint Task Force – 82nd Airborne, Army Lt. Col Christopher Garver tells Newsmax.

 

Also being deployed is the 4th Brigade, 4th Infantry Division, headquartered at Ft Carson, Colo., and the 5th Stryker Brigade, 2nd Division, headquartered at Ft. Lewis, Wash. The deployment will include roughly 9,000 solders, Garver said. Also included in the mix are 8,000 Marines serving with the 2nd Marine Expeditionary Brigade from Camp Lejeune, N.C. All of the combat troops will be under Army command, Garver said.

 

Obama recently announced the United States is sending 17,000 more troops into the mountainous land known as "the burial ground of empires” for the Afghan’s capacity to outlast every invader that has fought there. In the last 150 years it has driven out both the British and the Soviet Union after bitter protracted warfare that left both powerful nations exhausted.

 

The buildup will bring U.S troop strength in Afghanistan to more than 53,000 at the same time all of the major supply routes into the country except airfields inside Afghanistan have been closed by former supporters or interdicted by Al Qaeda financed opponents in Pakistan.

 

During February a key supply line for American and NATO forces in Afghanistan was disrupted by several attacks on bridges and road in the Khyber Pass. Taliban inspired attackers burned trucks carry U.S. supplies, blew up a bridge, and terrorized local drivers, Pakistani officials said.

 

The U.S. military’s logistical problems multiplied Feb. 19 when Kyrgyzstan's parliament approved a government order closing the Manas air base, used by the United States to transport supplies and troops to Afghanistan. The closure came after heavy pressure from neighboring Russia to close the base.

 

The air base is a key staging post for the reinforcement and supply of U.S. military forces in Afghanistan. Each month some 15,000 U.S. soldiers pass through it on the way to and from the conflict zone, along with 500 tons of supplies, the Pentagon says.

 

Bakiev reportedly said that he wants the Manas base closed because the United States is not paying enough for its use, according to Russian news sources.

 

Top U.S. officials, including Secretary of State Hillary Clinton, have voiced deep regret over the plan.

 

The importance of the Manas air to the U.S. and NATO mission in Afghanistan has grown significantly in recent months as Taliban insurgents have shown themselves capable of interrupting the main road supply route from Pakistan through the Khyber Pass to Afghanistan.

 

According to Russian news reports, the United States will have 180 days to leave the base once President Kurmanbek Bakiev signs the bill and the government issues an eviction notice.

 

Meanwhile Kazakhstan recently announced it was offering its territory for the transit of supplies to coalition troops in Afghanistan, following Kyrgyzstan's unexpected decision to shut a key US airbase.

 

The Republic of Kazakhstan is the ninth-largest nation in the world; the size of Western Europe. Its leader President Nursultan Nazarbayev has been in office since Kazakhstan became independent from the Soviet Union after it fell apart. In 1995 Nazarbayev called for a referendum that expanded his presidential powers, making him a virtual dictator.

 

"Kazakhstan has given its consent to the transit of cargo by land for the logistical material for the US contingent in Afghanistan," Kazakh foreign ministry spokesman Yerzhan Ashikbayev told reporters.

 

"We are only talking about non-military materials," he emphasized.

 

Tajikistan also said it was ready to allow US and NATO supplies for Afghanistan, including construction materials, medicines, fuel and water, to transit its soil by road.

 

Neither country will allow military supplies such as weapons and ammunition to cross their territory, their governments have announced.

 

The so-called “Stans” completely surround Afghanistan with the exception of Iran, which is a vocal opponent of U.S. and NATO policies in the region.

N.Y. Catholics: Dems Trying to Bankrupt Church

Democrats have declared war on the Catholic Church, with new laws that threaten to bankrupt Catholic schools, hospitals, charities and parishes. Thus far, the worst attacks have come in New York.

“We’ve taken a lot of hits this year,” Dennis Poust, spokesman for the New York State Catholic Conference, the policy arm of the state’s Catholic bishops, tells Newsmax. “Outside the government, the Catholic Church is the largest provider of health, human services and education in [New York]. But some legislators are so driven by malice that they’re willing to see our charities and schools go under.”

The Empire State’s Democrats are attacking on three fronts.

·  A proposal to require all hospitals to perform abortions, or lose their state license would put Catholic hospitals out of business.

·  Major funding cuts for Catholic schools by Gov. David Paterson, who continues to force the parochial schools to run state-mandated programs at their own expense.

·  An effort by Democratic lawmakers to abolish the statute of limitations on sex abuse lawsuits against the Church, allowing people to sue over decades-old cases in which the alleged perpetrators are dead.

The proposed sex-abuse law applies only to private institutions such as the Church and the Boy Scouts. Public schools are exempt. Yet sex abuse is more common in public schools than in private institutions.

"The physical sexual abuse of students in schools is likely more than 100 times the abuse by priests”, concluded a 2002 study by Hofstra University scholar Charol Shakeshaft. It estimated that 6 to 10 percent of U.S. public school students had been sexually abused by teachers and school employees.

An Associated Press investigation found that 485 “moral misconduct” charges were brought against New York State teachers between 2001 and 2005, most involving sex.

By contrast, new charges of sex abuse against Catholic priests in New York numbered “less than 10” during that same five-year period, says Poust.

Given these findings, the Child Victims’ Act of New York (Assembly Bill Number A.2596) seems strangely off the mark. First introduced in 2006 by Democratic state assemblywoman Margaret Markey, the bill is scheduled for a committee vote next week, to determine whether or not it will go to the assembly floor.

The bill targets private entities such as churches, but exempts government entities such as public schools. Under current law, a person who was abused as a minor can file suit up to five years after turning 18.

The new bill would suspend that five-year limit. It would open a one-year window, during which anyone could sue the Church -- or other private entities -- for alleged abuse going back 60, 70 years or more.

A similar law passed in California in 2002 produced so many lawsuits that the Church could not afford legal defense. It settled hundreds of cases, no matter how dubious the evidence, paying out more than $1 billion dollars.

Democrats hope for a similar bloodletting in New York. Markey’s current bill is modeled on the 2002 California law.

By contrast, New York state law discourages sex abuse claims against public schools.

A person charging sexual abuse against a public school must file a notice with the court within 90 days of his 18th birthday, or lose his right to sue.

Markey’s bill will not affect this 90-day deadline. Child molesters in public schools and other government entities would continue to enjoy special protection.

“It is unfair and bad policy when governments exempt themselves from lawsuits of a kind that can bankrupt their private counterparts,” states a Memorandum of Opposition sent to state legislators by the New York State Catholic Conference.

Markey’s bill would suffice, in and of itself, to bankrupt the Church in New York. But Democrats are also targeting Catholic schools and hospitals.

The federal Freedom of Choice Act (FOCA) may or may not pass this year. However, a state-level version may well pass in New York.

The so-called Reproductive Health and Privacy Protection Act (RHAPP) could potentially force all New York hospitals to perform abortions. Catholic hospitals could lose their licenses, for failing to comply.

Catholic schools are also threatened. Costs are rising, and competition growing. Government-subsidized charter schools, which charge no tuition, have lured many families away from Catholic education.

Since August 2008, Governor Paterson has been slashing funding to New York’s Catholic schools, while insisting that they continue paying for many state-mandated programs.

Dozens of Catholic schools have closed in New York. Brooklyn Bishop Nicholas DiMarzio is currently negotiating with Mayor Michael Bloomberg to save several doomed schools.

However, the deal will come with a high price. These schools will no longer preach the Gospel. They will become public charter schools, under city control.

“Religious instruction would be banned and religious symbols in the buildings would be covered,” reports The New York Times.

If the Church falls in New York, Catholic dioceses will tumble like dominoes across the nation. Where Nero failed, Democrats seem determined to succeed.

Kathleen Sebelius, current governor of Kansas and alleged Catholic, has distinguished herself in many ways. Most disturbing among them is her long-held support for the act of abortion. It is this single attribute that perhaps makes her attractive to President Obama, as he sets his sights on her as his nominee for the post of secretary of the Department of Health and Human Services.

By the way, those words, "health" and "human services" have a whole lot to do with the defining characteristics of the Sebelius era in Kansas.

For example, out of a sincerely held, very deep belief in the jaundiced view that abortion is nothing more than an aspect of reproductive health services, she has gone out of her way to embrace the culture of death. Her opinion, based on her statements and actions, is that every mother should have the right to choose to end the life of her own preborn child.

Sebelius has explained that though she is "personally opposed to abortion," she is "obligated to uphold state and federal laws and court decisions related to abortion."

When Sebelius vetoed the Comprehensive Abortion Reform Act last year, she explained in her veto message,  

I am concerned about a number of provisions in SB 389. The United States Supreme Court decisions make clear that any law regulating abortion must contain exceptions for pregnancies which endanger the woman's life or health. However, SB 389 allows a variety of individuals to seek a court order preventing a woman from obtaining an abortion, even where it may be necessary to save her life. I am concerned that the bill is likely unconstitutional or even worse, endangers the lives of women...

As Governor, nothing is more important to me than the safety, health and privacy rights of our citizens. I am vetoing SB 389 because it endangers the health of women and is likely to be found in violation [of] the United States Constitution and the Constitution of the State of Kansas.

The governor issued this statement with a straight face, though the message she received from her archbishop should have given her pause, since Sebelius is a so-called Catholic who has supported abortion for more than 20 years.

Archbishop Joseph Naumann reacted immediately, upon receiving word of the Sebelius veto, and issued this stinging rebuke: 

What makes the governor's actions and advocacy for legalized abortion, throughout her public career, even more painful for me is that she is Catholic. Sadly, Governor Sebelius is not unique in being a Catholic politician supporting legalized abortion.

Since becoming archbishop, I have met with Governor Sebelius several times over many months to discuss with her the grave spiritual and moral consequences of her public actions by which she has cooperated in the procurement of abortions performed in Kansas. My concern has been, as a pastor, both for the spiritual well-being of the governor but also for those who have been misled (scandalized) by her very public support for legalized abortion…

Having made every effort to inform and to persuade Governor Sebelius and after consultation with Bishop Ron Gilmore (Dodge City), Bishop Paul Coakley (Salina) and Bishop Michael Jackels (Wichita), I wrote the governor last August requesting that she refrain from presenting herself for reception of the Eucharist until she had acknowledged the error of her past positions, made a worthy sacramental confession and taken the necessary steps for amendment of her life which would include a public repudiation of her previous efforts and actions in support of laws and policies sanctioning abortion.

The archbishop stopped short, however, of stating that if Sebelius approached a priest, deacon or extraordinary minister of Holy Communion to receive the Eucharist, she would be denied. Pity! Sebelius ignored him in the same way she has been ignoring archbishops for years.

Since the archbishop's initial reprimand, things have clearly gotten worse. During the presidential election campaign, then-Senator Barack Obama had Governor Sebelius on his team of advisors regarding Catholic matters, and the archbishop explained in an interview,

What I found out after I took the pastoral action with Governor Sebelius is that Senator Obama had her on his advisory committee for Catholics...

I wasn't aware of that [beforehand] but I hope that it alerted Senator Obama that this is not probably somebody that can really counsel you in terms of the mind and the heart of the Church on this very critical and important area.

So I think it would be a bad judgment on Senator Obama's part to select someone who was in conflict with the Church.

By now, we all realize that now President Obama had no concern whatsoever for authentic Catholic doctrine, nor was he about to take advice from a Catholic who follows what the Church teaches. Quite the contrary, he surrounded himself both then and now with dissenters … Catholics who defied Church teaching and got away with it … and still get away with it!

To this very moment, no firm order has been given that the governor should be denied the sacrament, should she approach for the reception of Holy Communion.

The sad fact is that Sebelius will be making her way through the various government hearings held to ascertain whether or not she could be confirmed as the new HHS secretary under Obama. And during these hearings, she will probably be held to a higher standard by her political peers than she has been by Catholic bishops. Sebelius has been at the forefront of the abortion rights debate in Kansas for more than 20 years, and has yet to be clearly and resoundingly rebuked.

Bill O'Reilly has claimed that Sebelius is "not fit to serve"; he based this comment on her public alliance with the infamous late-term abortionist George Tiller. But, sadly, the Catholic bishops have not suggested that she is not fit to call herself Catholic.

Robert Novak labeled Sebelius "the national pro-choice poster girl" in May of last year. However, Catholic bishops have not taken definitive action to make sure she knows she is not authentically Catholic and must cease her public claims to the contrary!

I will give but one example of her long history of carrying the water for the pro-aborts. In Kansas in the 1980s, a mother and her preborn child were murdered in a case similar to the Scott Peterson case. In 1989, Sebelius was a state Kansas representative. A state law was proposed to define preborn babies killed in such ways as persons. But Sebelius opposed it, stating, "I think for me and a lot of other people there are certain inalienable rights established for a person, but those are not applied in utero."

In other words, in 1989, Sebelius refused to acknowledge the fact that a baby exists in his mother's womb prior to birth. That was 20 years ago … the archbishop took no corrective action.

The sad fact is that over these many years, no Catholic bishop has taken steps to correct Sebelius in a meaningful way. She has repeatedly ignored the public statements of her bishops. Over time, Sebelius has become recalcitrant in her support for abortion, which she clearly believes is but another aspect of health care. Sebelius represents all that is despicable about the movement that strives to protect abortion rights at all costs, as though abortion itself were a sacrament.

So now, we come to the present moment and the prospect of having this woman preside over a department concerned with public "health" and the provision of "human services." What an oxymoron that is!

What kind of health care is it that provides for murdering an innocent preborn child as a solution to a perceived problem? And what kind of human service is it to discard, on the garbage piles of America, the bodies, bones and blood of little babies who never had a chance to live?

Macabre, is it not, that we are facing the prospect of having an advocate of human butchery in one of the most pivotal positions in our nation's government? It is disturbing as well that a so-called Catholic may assume this role with nary a word of genuine repudiation from Catholic shepherds.

The Planned Parenthood Federation of America (PPFA), despite coming under frequent attacks by pro-lifers, remains one of the most respected and well-funded organizations in the country. Add the International Planned Parenthood Federation (IPPF) to the equation, and you've got a billion-dollar industry in human fertility. One would expect that the aims and agenda of such a huge organization would come under severe scrutiny, but Planned Parenthood has been immune from such questions, largely because its stated goals of population control and family planning are supposedly in agreement with America's interests at home and abroad. But is PPFA's stated agenda the whole story? One way of determining PPFA's real agenda is to study its history. PPFA was founded with the establishment of the nation's first birth-control clinic in 1916 by Margaret Sanger. The clinic was located in Brownsville, New York, a poor neighborhood of mostly Jews and Italians, establishing a pattern of targeting poor and minority populations for family planning. The organization went through various name changes -- the American Birth Control League (ABCL), the Clinical Research Bureau, the National Committee for Federal Legislation for Birth Control (NCFLBC), the Birth Control Federation of America -- before becoming Planned Parenthood in 1942.

Pro-abortion activists have criticized pro-life people for opposing FOCA (the “Freedom of Choice Act”) even though it hadn’t been introduced again in Congress. This is very typical of abortion supporters. While they hallucinate every day about the pro-life movement as being threatening and violent, they criticize us when we try to stop legislation that has been introduced twice in the past and represents the goals of those who have gained power in Washington in the last election. It’s amazing to see the double-standard that abortion supporters have, especially since they are precisely the ones who want to see every restriction on abortion eliminated. And that’s precisely what FOCA is designed to do. These proposals will likely be introduced one piece at a time. It is common sense to oppose them.

In 1999, Fr. Pavone was named among the Top 100 Catholics of the Century. He serves on Dr. James Dobson's Focus on the Family Institute. The National Right to Life Committee awarded him their highest honor, the Proudly Pro-life Award. The Franciscan University of Steubenville bestowed on him an honorary doctorate, in recognition of his pro-life work. Fr. Pavone currently serves as President of the National Pro-life Religious Council, a coalition of groups from many different denominations working to end abortion. He is also Pastoral Director and Chairman of the Board of Rachel's Vineyard, the largest ministry in the world for healing after abortion.

Arch-conservative Alan Keyes is not giving Barack Obama any honeymoon.

After the Los Angeles Times “Top of the Ticket” column picked up Keyes’ comments - taken from an impromptu interview posted to YouTube - about Obama from last week, those comments have been the buzz of the web this past weekend.

Keyes, a former U.S. ambassador, ran against Obama in 2004 as the Republican Senate candidate in Illinois.

In his diatribe against the new president, Keyes calls Obama a “radical communist” and says “he will destroy this country” and warns that unless he is stopped, America “will cease to exist.”

Keyes also says Obama has failed constitutional muster to become president, since, Keyes argues, Obama was born in Kenya.

Obama has stated he was born in Hawaii. His campaign has released his Certificate of Live Birth - not his actual birth certificate. Hawaii state officials said they reviewed the actual birth certificate and that Obama was born in the state of Hawaii.

Also, Obama’s family placed a legal advertisement in a Hawaii newspaper days after he was born.

Individuals who earn more than $200,000 a year and families who make more than $250,000 would also lose the tax cuts enacted during the Bush administration, meaning their top income tax rate would rise to 39.6 percent from 35 percent, their investment income would be taxed at 20 percent rather than 15 percent and their deductions for mortgage interest, state and local taxes and charitable contributions would be reduced.


The attack on the mortgage interest rate deduction and the charitable deduction are simply hidden ways to increase the top rate beyond that of the Clinton years, but by using the deception, the Obama plan would devastate churches and charities that depend on the generosity of their highest income donors while also slamming the value of homes by reducing their value to borrowers.

I have argued with the FairTax advocates for years that their plan was a dangerous one because it struck at these two deductions which undergird so much of the American safety net and Americans' wealth.  If President Obama wants to raise rates above 39.6 percent, he should do so openly and honestly, and without doing enormous damage to the not-for-profit and housing sectors.

Democrats who vote for this scheme are voting against every church in the land and against the equity every American has in their home.  Radical plans like this one make academics happy and voters angry.  Very angry.

The GOP must immediately make clear that it will do all it can to defend churches and homeowners against this assault, and they must identify the 50 Democrats must vulnerable in 2010 and begin a very detailed web-based watch on what they say and do on these issues.  It will be easy to explain why the plan assaults churches, synagogues, veterans' organizations, childrens's hospitals, private schools and not-for-profits of all sorts, and only slightly more difficult to explain that destroying part of the appeal of a home purchase hammers the entire housing market --from entry level to mansion-- but these arguments have to be made again and again.

It is a radical plan, and no amount of smoke will cover that fact.  Today's Wall Street Journal editorial quickly covers the enormous, permanent expanision of government the budget proposes.  President Obama did not push these radical ideas on the campaign trail, nor did any Democrat I am aware of.  The Republicans and moderate Democrats have to stand up and refuse this invitation to fundamentally alter the American economy and its deeply embedded values of giving and home ownership.

It is with great humility and an even greater honor for the American Veterans Aid Fund that Lawrence Tremblay, Sr., Father of Cpl. Joseph S. Tremblay, USMC, KIA-Iraq, has allowed us to pay tribute to his son and all fallen heroes through the establishment of this education/scholarship fund in his hero son's name.
 
About Corporal Joseph S. Tremblay: Joseph was born on November 13, 1981 in Ridgewood, NJ to Lawrence Tremblay, Sr., and Tina Marie Remo. He graduated in 1999 from Newburgh Free Academy and also attended Orange County Community College.
 
Joseph joined the Marine Corps just after graduation from the Academy in 1999 and completed a four-year tour. He remained in the Marines Reserve and signed up for active duty when the call went out for volunteers. During his tour of duty, he served in Hawaii, Japan, and Australia.
 
His beloved family and friends are proud of his dedication in the service of our country. He stands for freedom, honor, and dignity. His memory remains forever!
